Terms of Service

These terms are an agreement between you and Fox Parade ("we," "us"), based in Charleston, SC. By creating a film or joining one — on the website or in the Fox Parade iOS app — you agree to them. They're written to be read, not skimmed past; the whole thing takes about four minutes.
Fox Parade lets a host create a shared event camera (a "film"), lets invited guests take a limited number of photos in it, and reveals the gallery at a time the host chooses. Guests join through a link or QR code in a web browser, or through the iOS app. The host decides the film's settings when creating it — including who can see the developed film — and some of those choices (like visibility) are locked in once the film exists.
You must be able to form a binding contract to host a film, and at least 13 to have an account. Guests under 13 may participate only with a parent or guardian's involvement. Hosts are responsible for inviting appropriate participants to their events.
You own what you shoot. Guests keep all rights to their photos; hosts keep all rights to their film details and cover images. License to us: you grant Fox Parade a limited license to store, process (including applying the film look and timestamps), and display your content within the film's private gallery — solely to operate the service. It ends when the content is deleted. License within the film: by shooting in a film, you grant the host and that film's participants the right to view and download your photos for personal use — that's the point of the product. If a host chose the "only-the-host-sees" setting, your shots are visible to the host alone.
There is no place at Fox Parade for content that is unlawful, infringing, harassing, hateful, or sexually exploitative — we have zero tolerance for objectionable content and abusive users. Don't photograph people in ways that violate their reasonable privacy expectations; don't try to access films you weren't invited to; don't probe, overload, or reverse-engineer the service. Every photo and comment can be reported in the app (we act on reports within 24 hours), anyone can be blocked, and hosts can remove any photo from their film. We may remove content, eject participants, or suspend accounts that break these rules — quickly and without ceremony when an event's memories are at stake.
Paid films are priced per event — a one-time purchase, no subscription, nothing auto-renews. Pricing depends on guest capacity, and capacity upgrades take effect the moment the purchase completes. In the iOS app, purchases are made through Apple's App Store and are subject to Apple's payment terms; refund requests go through Apple's standard process (and if something went wrong on our end, email us — we'll be reasonable). Features offered free during the beta are provided as-is and may change. Guests never pay.
Galleries don't automatically expire — your photos are safely stored so you can relive the event anytime. Hosts may delete a film (which deletes its photos for everyone) at any time; guests may delete their own photos; app accounts can be deleted in Settings, which removes your content everywhere. We may remove content as required by law or by section 4.
We're a small company shipping fast. We may change, suspend, or discontinue features, and while we work hard to be reliable — especially on event days — we can't guarantee uninterrupted service or that every upload succeeds on every network. The app queues shots taken offline and uploads them when signal returns, but take the shots that matter most on a good connection.
The service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us for the film in question — or $50 if you paid nothing. Nothing in these terms limits liability that cannot lawfully be limited.
These terms are governed by the laws of the State of South Carolina. Disputes will be resolved in the state or federal courts located in Charleston County, SC.
